Terms and fee arrangements
How this website may be used, and a plain summary of how "no win, no fee" works for claims in Scotland.
1. About us
Kinetic Lawyers is a firm of lawyers regulated by the Law Society of Scotland. More detail is on our regulatory information page.
2. Using this website
The information on this website is general guidance on Scots law. It is not legal advice about your situation, and reading it or contacting us through it does not by itself make you our client. We only act for you once we have agreed to take on your case and sent you our terms of engagement in writing.
We try to keep the information accurate and up to date, but the law changes and we cannot accept responsibility for decisions made on the basis of this website alone.
3. "No win, no fee" in Scotland
In Scotland, "no win, no fee" is usually provided through a success fee agreement (sometimes called a speculative fee agreement), under the Civil Litigation (Expenses and Group Proceedings) (Scotland) Act 2018. In outline:
- No upfront fees: you do not pay us a fee to start your claim.
- If the claim fails: you do not pay us a fee.
- If the claim succeeds: our fee is an agreed share of the compensation. For personal injury claims, the maximum share is set by law.
- The other side's expenses: under qualified one-way costs shifting, people bringing personal injury claims are generally protected from paying the other side's legal expenses if the claim fails, provided the claim is conducted properly.
This is only a summary. If we take on your case, we will give you a written agreement setting out exactly what you would pay and when, and we will go through it with you before you sign.
4. Our service to you
We will explain your options clearly, keep you informed, advise you on any offer made to settle your claim, and act in your best interests throughout.
