Legal
Privacy notice
How we collect, use and protect your personal information, in line with UK GDPR and the Data Protection Act 2018.
1. Who we are
Kinetic Lawyers ("we", "us") is responsible for the personal information you give us when you contact us or instruct us on a personal injury, industrial disease or military claim. In data protection terms, we are the controller of that information.
Our address is 2.7, The Hub, 70 Pacific Quay, Glasgow G51 1EA. You can contact us about this notice or your data at info@kineticlawyers.co.uk or on 0141 488 8541.
2. Confidentiality
What you tell us about your claim is treated as confidential, and communications for the purpose of legal advice are protected by legal professional privilege under Scots law. We do not sell your information, and we do not pass it to claims management companies or marketing firms.
3. Information we collect
When you send an enquiry or instruct us, we may collect:
- contact details, such as your name, address, phone number and email address;
- details of your accident, workplace noise exposure or military service;
- health information, such as medical records, hearing tests and medical reports needed to prove your claim (this is "special category" data and has extra protection);
- financial information, such as payslips and tax records, needed to work out lost earnings and other losses.
4. How we use it
We use your information to:
- reply to your enquiry and assess whether you have a claim;
- give you legal advice and act for you under Scots law;
- instruct medical and other experts;
- deal with the other side and their insurers, and raise court proceedings if needed;
- meet our legal and regulatory duties, including those set by the Law Society of Scotland and anti-money laundering rules.
Our lawful bases are taking steps at your request before entering into a contract, performing our contract with you, complying with legal obligations, and our legitimate interests in running the practice. We process health information because it is needed to establish, bring or defend legal claims.
5. Enquiries sent through this website
If you use a form on this website, the details you enter are sent to us so that we can reply. Depending on how the form is set up, this may be through your own email program or through a secure form-handling service acting on our behalf.
Maps
Our about and contact pages show an embedded Google Map of our office. When that map loads, Google receives your IP address and may set cookies, under Google’s privacy policy. If you would rather avoid this, you can use the written address and directions instead.
6. Who we share it with
We share your information only where needed to deal with your claim or where the law requires it, for example with medical experts, advocates, the courts, the other side and their insurers, and our regulators. Anyone acting on our behalf must keep your information secure and use it only as we instruct.
7. How long we keep it
We keep client files for as long as needed to deal with your claim and then for a set period afterwards to meet legal and regulatory requirements. Enquiries that do not lead to a claim are kept for a shorter time.
8. Your rights
Under UK GDPR and the Data Protection Act 2018, you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct information that is wrong;
- ask us to delete information, where we are not required to keep it;
- object to or ask us to restrict how we use it;
- ask for information you gave us to be transferred to another organisation.
To use any of these rights, email info@kineticlawyers.co.uk or write to us at the address above.
9. Complaints
If you are unhappy with how we have handled your information, please tell us first so we can try to put it right. You can also complain to the Information Commissioner's Office (ICO) at ico.org.uk.
